It’s illegal, to put it bluntly. Unfortunately in today’s America, discrimination against Asian-Americans is kind of the last frontier and the justification for that is Asian Americans on average students overperform. If we allow people based on merit, you have more than 50% of the Harvard community being Asian-Americans and we can’t have that because the left believes in racial gerrymandering that way. So they assign low personality scores to Asian candidates and use that as a proxy for elimination of the students, even without meeting the students. That is obviously illegal and the federal government has stepped in because they give funds to Harvard and Harvard has to comply with title VI and other civil rights regulations. I think they have a great case. I look forward to seeing all of this play out in October.
